Terms and Conditions of Sale (CGV)
All orders placed via the "THEOBROMA BEAUTY" website are governed by these general terms and conditions of sale. These terms prevail and apply to the exclusion of all other conditions or agreements. They define the rights and obligations of each party. Each customer acknowledges having read, understood, and accepted these general terms and conditions of sale without any reservation.
Conditions of Use
The use of THEOBROMA BEAUTY’s online store makes you personally responsible for the security of your identification data (username and password) and for restricting access to the computer you use to connect to the store. In case of suspected access to your personal data and/or your account by a third party, or fear that someone has improperly obtained it to access it, you are required to inform us immediately.
Personal Data
THEOBROMA SECRET is committed to respecting the confidentiality of personal data provided by customers when placing an order on this website and to processing them within the limits imposed by law.
The customer undertakes to provide the necessary personal data for the proper processing of their order (billing and delivery). The customer also undertakes to ensure that these details are accurate and up-to-date at the time of ordering.
Contract Initiation
The contract takes effect as soon as the customer has entered the payment information and it has been validated on the "THEOBROMA BEAUTY" website. The order is thereby placed.
The presentation of the products in our online store does not constitute a legally binding offer but merely a non-binding online catalog.
Order confirmation is immediate via an automated email and does not yet constitute acceptance of the contract. We then check your order and the availability of the ordered products. We may conclude the contract either by sending a contract confirmation or by delivering the goods within ten days.
Orders
The customer places an order via this website and adds the selected product to their shopping cart by clicking the "add to cart" button. At any time, they can continue selecting items, modify their shopping cart, or complete their order and pay for the selected products.
Any order placed on this website by validating the shopping cart commits the customer to purchasing the selected products according to these general terms and conditions of sale.
The customer cannot add to or cancel an order once it has been placed. No refund is issued to the customer.
Order Confirmation
Once the order is confirmed and payment is made, the customer receives an order confirmation email. After this email is sent, it is no longer possible to change the delivery address, except in the case of an error in the postal code or house number.
The data recorded by THEOBROMA BEAUTY constitutes irrefutable proof of the order or transaction carried out. All data recorded by the financial system constitutes irrefutable proof of financial transactions.
In the event of a subsequent rejection of the payment method, THEOBROMA BEAUTY reserves the right to refuse or cancel the delivery of any order placed on this website at its discretion, as long as the payment has not been settled.
Prices
The prices payable for the products are those displayed on this website at the date of the order, including VAT, excluding delivery costs. Delivery costs are charged in addition to the ordered products. These costs are visible at the time of the shopping cart summary. They are calculated according to the customer’s location at the time of the order, which will be required.
Product Representation
THEOBROMA BEAUTY strives to ensure that the product photographs displayed on this website match reality as closely as possible. However, depending on the way the product is presented on the internet, the customer’s perception of the product may potentially differ from reality.
Payment
We decline any responsibility for additional bank fees or currency conversion fees associated with the use of credit or debit cards issued by banks outside the country of delivery.
In accordance with current regulations and to ensure the security and confidentiality of their information, THEOBROMA BEAUTY does not store its customers’ banking data. It is the customer’s responsibility to save and print their payment certificate if they wish to keep the payment details related to their order. Credit card data is encrypted to protect the customer.
Delivery
Delivery costs are calculated at the end of the order according to the shopping cart, weight, volume, and rates of the carrier in charge of delivery. They are borne by the customer unless a special promotion is specified by the seller.
From the time of order and payment confirmation, delivery times, as an indication, are 2 working days but may extend up to 8 working days in very rare cases.
The customer is responsible for verifying the quantity and condition of the goods as soon as the products are handed over. In the event of an error (damaged or missing product), the customer must report it within seven days to THEOBROMA BEAUTY by email at the following address: contact@theobromabeauty.com.
THEOBROMA BEAUTY will replace the missing or damaged product with an identical one if the error is confirmed by its own services.
THEOBROMA BEAUTY products cannot be returned or refunded once they match the order form in every respect and show no defects attributable to THEOBROMA BEAUTY.
Returns
For orders in Europe: DISPEO Beauvais, Rue Hippolyte Bayard, 60000 Beauvais, France.
For orders in Switzerland: Sensation Beauty SA, Rue de Jehanne de Hochberg 1, 2000 Neuchâtel, Switzerland.
Management of Unjustified Returns
The following are considered unjustified returns:

Any return initiated by the customer for reasons other than a defect, non-conformity, or hidden defect.

Any return of an order delivered to a pick-up point by the customer’s choice and not collected within the allotted time (8 days at the pick-up point, 5 days in lockers).
In the case of an unjustified return, a management fee of €15 will be deducted from the refund. This fee covers all administrative and logistical costs incurred in processing the return.
This measure does not apply to returns related to an error on our part or the observation of a defect inherent to the product, for which legal withdrawal and warranty provisions remain applicable.
This measure also does not apply in case of a lack of information from the carrier on the drop-off location and holding times.

THEOBROMA BEAUTY offers its loyal customers a loyalty program entitled "My Théobroma," designed to reward our customers for their purchases and loyalty by allowing them to accumulate points that grant access to exclusive discounts.
